Stable patent pools

چکیده
We study endogenous formation of patent pools in the framework of Lerner and Tirole (2004). Open membership coalitions as well as closed membership coalitions are considered. We show that complete pools are formed under both mechanisms only if restrictive conditions are satisfied. As in this game a coalition may impose negative or positive externalities on outsiders, it depends on model parameters whether closed pools tend to be more concentrated than

Economics of Patent Pools When Some (but Not All) Patents Are Essential
Several recent technological standards have been accompanied by patent pools – arrangements to license multiple patentholders’ relevant intellectual property as a package. A key distinction made by regulators – between patents essential to a standard and patents with substitutes – has not been addressed in the theoretical literature. I show that pools of essential patents are always welfare-pos...

This paper explores in what circumstances patent owners can be expected to join unilaterally a patent pool. We develop a simple model in which owners of patents reading on a standard grant licences to competing manufacturers. Manufacturers must sink a xed cost to enter the market for standard compliant products, and are thus exposed to a hold up when royalties are set after their entry. We sho...

Patent pools do not correct all problems associated with patent thickets. In this respect, patent pools might not stop the outsider problem from striking pools. Moreover, patent pools can be expensive to negotiate, can exclude patent holders with smaller numbers of patents or enable a group of major players to form a cartel that excludes new competitors. For all the above reasons, patent pools ...
متن کاملStandards, Innovation Incentives, and the Formation of Patent Pools
Technolgical standards give rise to a complements problem that affects pricing and innovation incentives of technology producers. In this paper I discuss how patent pools can be used to solve these problems and what incentives patent holders have to form a patent pool. I offer some suggestions how competition authorities can foster the formation of welfare increasing patent pools.
